Filing and registration of import-export rights for FIEs

Under the existing administrative measures on filing and registration, FIEs approved for establishment before 1 July 2004 but have not applied for change of business scope to include additional import-export activities,


as well as FIEs approved for establishment after 1 July 2004 that handle the import of goods and technologies for own use and export of own products, do not have to go through foreign trade operator filing and registration formalities separately.


For FIEs already established which request for enlargement of its import-export activities on the basis of the approved scope, they should apply for change of business scope in the business licence in accordance with the Measures and complete the filing and registration formalities by presenting the original FIE approval certificate,


the altered business licence with enlarged business scope and other documents as required by the Measures.


The registration organ will stamp on the Registration Form a seal reading “not including the distribution of imported commodities”.


For newly-established FIEs, if the business scope applied for includes the foreign trade rights for the import of goods and technologies not for own use and export of goods and technologies not produced by themselves, the examination and approval organ would specify in their business scope “import and export business (not including distribution)”.


After establishment, the enterprise should go through the filing and registration procedures as stipulated in the Measures.

For FIEs granted approval to engage in import-export and distribution business, when they go through the filing and registration procedures as stipulated in the Measures,


the filing and registration organ will not stamp on the Registration Form the seal reading “not including the distribution of imported commodities”.
